GENERAL PURPOSE OF THE JOB:

This position will report to the Sr. Director, Referral Source Arrangements, HSG, and Post-Acute Services, Compliance and is primarily responsible for leading the Company's successful execution of several key areas of our day-to-day compliance program including, but not limited to:

  • Leading a team that reviews and assesses Anti-Kickback Statute and other compliance risks associated with referral source agreements, such as medical director agreements, hospital services agreements, personal services agreements, transactions, and leases.
  • Serving as the day-to-day compliance leader to the senior leadership of DaVita's Hospital Services Group and leading a compliance team that supports the business.

This person will provide compliance guidance and support to the teams above on compliance-related matters, including, but not limited to federal and state fraud and abuse laws, and other health care regulatory laws as such matters arise in the context of inpatient hospital dialysis services, outpatient dialysis centers and related businesses. This person will partner with their internal clients to develop, enhance, or sustain compliance program elements for projects related to health care regulatory laws and regulations. This person will also liaise between business clients, legal and compliance to ensure fraud and abuse risk is low as it relates to DaVita's agreements with referral sources.

ESSENTIAL DUTIES AND RESPONSIBILITIES

  • Manages team of compliance professionals including performance management and talent development.
  • Interprets and applies the Anti-Kickback Statute and aspects of DaVita's policies and procedures to our referral source agreements, such as hospital services agreements, medical director agreements, personal services agreements, transactions, and leases.
  • Serves as Chairperson of the Hospital Services Group's Management Compliance Committee.
  • Leads annual risk assessment process across Hospital Services Group and assessment of annual compliance plan with actions and timelines.
  • Oversees development, modifications, communications, and implementation of policies and procedures including those related referral source arrangements and other compliance related policies.
  • Oversees development and implementation of compliance communications to key stakeholders.
  • Oversees development, modifications, communications, and implementation compliance training (e.g., annual compliance training, new policy training) to key stakeholders.
  • Collaborates with other compliance teammates on the development and execution of monitoring plans related to referral source arrangement performance and payment monitoring.
  • Partners with internal audit teams to design annual audit plan for business.
  • Partners and collaborates with senior leadership and legal counsel to develop guidance on all new and current business initiatives.
  • Partners with other compliance teammates, regulatory attorneys, business attorneys, IT, finance, accounting, and business clients in identifying and resolving compliance matters.
  • Monitors changes in relevant regulatory areas to assess compliance program gaps.
  • Manages special projects as needed.
  • Travel required Minimal.

MINIMUM QUALIFICATIONS

  • Bachelor's degree required; JD/CPA/MBA or other relevant advanced degree or certification preferred.
  • Experience in the health care industry and knowledge of health care fraud and abuse laws and regulations, including the Anti-Kickback Statute, is required.
  • Minimum of 5-8 years' experience as a legal or compliance professional responsible for the development, implementation and sustainment of an effective compliance program.
  • Experienced people manager, expert at selecting, managing, and maximizing direct reports and their teams through coaching, mentoring, development, and fun.
  • Demonstrated project management experience, including ability to develop and deliver project plans and timelines to senior leadership.
  • Demonstrated ability to present and communicate effectively with executive management, business leaders, and field employees.
  • Proven track record of collaborative problem solving with senior management and business leaders to achieve business goals.
  • Superior writing and communication skills.
  • Knowledge of financial processes beneficial.
  • Hospital experience preferred.
  • Prior experience with providing legal/regulatory advice to health care providers preferred.
  • Prior experience working under or advising clients related to a CIA/DPA or other state/federal regulatory oversight is beneficial.

  • Demonstrated business acumen, including the ability to see the "big picture" as well as very detailed and specific business issues.
  • High degree of organization and efficiency.
  • Hands on, efficient and proven ability to "Get [a lot of] Stuff Done" with a bias for action and strong sense of ownership.

Salary/ Wage Range

$100,100.00 to $147,000.00

Compensation for the role will depend on a number of factors, including a candidate's qualifications, skills, competencies and experience and may fall outside of the range shown.
